Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the HireData platform and related services offered by HireData B.V., Keizersgracht 520H, 1017 EK Amsterdam, The Netherlands (Chamber of Commerce: 37125140) (“HireData”, “we”, “us”, “our”).

By creating an account (including a free-tier account), using our platform, or otherwise accepting these Terms, you agree to be legally bound by them. If you are entering into these Terms on behalf of a company, you confirm you have authority to bind that company.

1. Our Services

HireData is a B2B software platform that helps companies automate communication, tasks, and workflows using data and AI. We integrate with third-party systems (e.g. ATS, CRM, marketing tools) and enable users to trigger actions across platforms, including via APIs and third-party channels (e.g. WhatsApp, email, SMS).

We aim for 99.9% availability each month (excluding planned maintenance and factors outside our control), and publish real-time service status at status.hiredata.com. This is a target, not a guarantee.

2. Accounts & Eligibility

  • You must be a business or professional user.
  • You are responsible for all activity under your account, including ensuring that your use complies with these Terms and applicable law.
  • Free-tier accounts are subject to these Terms. For free plans, our liability is limited to €0.

3. Usage & Billing

  • Paid plans may include a set number of tasks or credits per billing period. Unused credits expire at the end of the period unless otherwise agreed.
  • Additional usage beyond your plan will be billed at the then-current rates.
  • All fees are exclusive of VAT and other applicable taxes.
  • We may change pricing with at least 30 days’ notice before your next renewal.
  • We may suspend or limit your access if you fail to pay on time.

4. Acceptable Use

You may not:

  • Use the platform for unlawful, harmful, discriminatory, or deceptive purposes
  • Send spam or unsolicited communications in violation of applicable laws (e.g. ePrivacy Directive, local anti-spam laws)
  • Upload or process special categories of personal data (GDPR Art. 9) unless strictly necessary, legally justified, and processed securely
  • Transmit viruses, malware, or harmful code
  • Infringe third-party intellectual property rights
  • Interfere with platform security or stability, or attempt to reverse engineer our software
  • Use the platform for high-risk purposes where errors could cause personal injury or severe damage
  • Engage in activity that, in our reasonable opinion, poses a security, legal, or reputational risk to us or our partners

5. Data & Privacy

  • You are the data controller for any personal data you upload or process via HireData; HireData is your data processor.
  • Our Data Processing Agreement (DPA) applies to all processing of personal data.
  • Our Privacy Policy explains how we handle data.
  • You confirm that you have a valid legal basis for processing and sharing personal data with us, and that any required consents have been obtained.

We may retain anonymised or aggregated data after account closure for analytics, service improvement, and AI model training, provided it cannot identify any individual.

6. AI Features

  • Some features generate content automatically using AI. Outputs may be inaccurate, incomplete, or inappropriate.
  • You are solely responsible for reviewing and verifying AI outputs before use, and for ensuring your use of such outputs is lawful.
  • We design and operate our AI features in line with the EU AI Act and other applicable regulations, but you remain responsible for compliance in your own context.

7. Integrations & Third Parties

HireData integrates with third-party platforms (e.g. Google, Meta, Carerix). You are responsible for complying with those platforms’ terms and ensuring your use meets their requirements. We are not liable for the availability, security, or functionality of third-party services.

8. Intellectual Property

  • We own all intellectual property rights in the HireData platform, including software, designs, and content.
  • You may not copy, distribute, or re-use any part of the platform without our prior written permission.
  • You retain ownership of the data and content you provide to us.

9. Suspension & Termination

We may suspend or terminate your access if you:

  • Violate these Terms or applicable laws
  • Fail to pay fees when due
  • Engage in activity that creates security, legal, or reputational risk for us

You may close your account at any time. Upon termination, we will delete or return personal data as described in the DPA.

10. Warranties & Disclaimers

We provide the platform “as is” and to the maximum extent permitted by law, disclaim all warranties (express or implied), including merchantability, fitness for a particular purpose, and non-infringement.

11. Liability

To the extent permitted by law:

  • Our total liability is limited to the amount you paid us in the 6 months before the event giving rise to the claim (or €0 for free plans)
  • We are not liable for indirect, incidental, or consequential damages

12. Changes

We may update these Terms from time to time. If we make material changes, we will notify you (e.g. by email or in-app notice). Continued use after changes take effect means you accept the updated Terms.

13. Governing Law & Disputes

These Terms are governed by Dutch law. Any disputes will be submitted to the competent courts in Amsterdam, The Netherlands.
